Spouse maintenance is financial support paid by a party to a marriage or defacto relationship to their husband or wife or partner, where a marriage or de facto relationship has broken down, in circumstances where the party seeking support is unable to adequately support him/herself.

If you are seeking spouse maintenance, you need to meet certain criteria.  You must satisfy the court that the person from whom you are seeking financial support can reasonably afford to pay.  You also must prove that you are unable to adequately support yourself due to a limited number of circumstances set out under the Family Law Act 1975.
